{"id":2355,"date":"2019-04-16T11:13:45","date_gmt":"2019-04-16T09:13:45","guid":{"rendered":"https:\/\/barzano-zanardo.snaptest.it\/?post_type=approfondimenti&#038;p=2355"},"modified":"2019-04-16T11:13:45","modified_gmt":"2019-04-16T09:13:45","slug":"industrial-property-rights-requirements-and-application-scopes","status":"publish","type":"approfondimenti","link":"https:\/\/barzano-zanardo.com\/en\/approfondimenti\/industrial-property-rights-requirements-and-application-scopes\/","title":{"rendered":"Industrial Property Rights: Requirements and application scopes"},"content":{"rendered":"<p><u>Industrial property rights: the meaning?<\/u><\/p>\n<p>The phrase \u201cindustrial property right\u201d indicates an <strong><u>exclusive right<\/u><\/strong> given to a subject upon a specific industrial asset or an intellectual creation.<\/p>\n<p>It basically means that with this right it is possible to <strong>oppose to any unauthorized use<\/strong> of the mark, the work, the drawing or the invention by third parties in the market and to <strong>call on the competent judicial authorities to obtain the immediate suspension of such illicit use<\/strong>.<\/p>\n<p>Therefore, industrial property rights are needed to <strong>protect entrepreneurs <\/strong>or<strong> authors<\/strong> from the risks of illegitimate appropriation or <strong>exploitation of their work<\/strong>.<\/p>\n<p><u>\u00a0<\/u><\/p>\n<p><u>Types of industrial property rights and advantages:<\/u><\/p>\n<p>The <a href=\"https:\/\/barzano-zanardo.com\/en\/ip-strategy\/trademarks\/\" target=\"_blank\" rel=\"noopener\"><strong>TRADEMARK<\/strong> <\/a>\u00a0is one of the best known and more widespread industrial property rights.<\/p>\n<p>It protects the <strong>sign used by a company to distinguish its products or services from those of competitors<\/strong>. It can be considered like the company\u2019s business card.<\/p>\n<p>It can have several aspects and can be represented by words, drawings, letters, numbers, sounds, shape of the product or packaging, colour combinations or shades.<\/p>\n<p>It is necessary for a trademark to be effective that it is <strong><u>new<\/u><\/strong>, hence different and not to be confused with other previous trademarks, and has <strong><u>distinctive character<\/u><\/strong>, therefore it can identify and distinguish certain goods or products in the market.<\/p>\n<p>Generally speaking, a trademark with distinctive character doesn\u2019t have <strong><u>any link with the object it identifies<\/u><\/strong>, that is to say it has <strong><u>no conceptual connection with the product<\/u><\/strong> it marks, in order to capture the consumer\u2019s attention more easily.<\/p>\n<p>Examples:<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-2356\" src=\"https:\/\/barzano-zanardo.com\/wp-content\/uploads\/2019\/04\/Le-Privative-Industriali1-1.png\" alt=\"\" width=\"1106\" height=\"374\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>The advantage to have a strongly distinctive trademark is that it\u2019s likely to get a <strong>broad and solid protection<\/strong>, to be used also against partial or limited imitations. On the contrary, a trademark bearing a limited distinctive character because partially descriptive can be <strong>protected only against identical or straightforward knockoffs<\/strong>.<\/p>\n<p>Trademark protection usually starts with its <strong><u>registration<\/u><\/strong> before the competent administrative office (in Italy, it\u2019s the UIBM), lasts <strong><u>10 years<\/u><\/strong> and it\u2019s renewable <em>ad libitum<\/em>.<\/p>\n<p>The Italian national regulation allows to protect also the so-called <strong><u>de facto trademark<\/u><\/strong>, which is the trademark only used but not yet registered. However, in this regard, the protection is subject to specific conditions of use and distribution, which are not always easy to demonstrate in court.<\/p>\n<p>Another IP right is the <strong><a href=\"https:\/\/barzano-zanardo.com\/en\/ip-strategy\/patents\/\" target=\"_blank\" rel=\"noopener\">PATENT<\/a>.<\/strong><\/p>\n<p>With patents it is possible to protect <strong>new and original solutions to technical problems never solved before. <\/strong>These solutions must be<strong> capable of industrial application.<\/strong><\/p>\n<p>An invention in order to be patented has to bring an <strong>improvement<\/strong> to the previous techniques and knowledge and to represent an <strong>original and new<\/strong> activity. It is therefore fundamental that the invention <strong>hasn\u2019t been spread or made accessible to the public, <u>even by the inventor him\/herself<\/u>, <\/strong>before the application is filed.<\/p>\n<p>Among the invention protected by patents there are Moka Express by Alfonso Bialetti or the three-point safety belt by Nils Bohlin.<\/p>\n<p>A patent allows the inventor to stop others from producing, selling or using his\/her creation, being it a product (so-called product patent) or a process (process patent).<\/p>\n<p>A patent\u2019s duration is <strong><u>20 years<\/u><\/strong> starting from the filing date and, contrary to the trademark, <strong>it cannot be renewed<\/strong> when it expires.<\/p>\n<p><strong>UTILITY MODELS<\/strong> are patent-like IP rights, but they differ from patents because they don\u2019t protect a new and original invention, but a <strong>new form of an industrial product giving it a \u201c<em>particular effectiveness or comfort in application or use<\/em>\u201d<\/strong>.<\/p>\n<p>Compared to patents, utility models don\u2019t provide a new solution to a technical problem and the <strong><u>innovation affects only side and executive aspects of something already known, by giving it more benefits and comforts.<\/u><\/strong><\/p>\n<p>Regulations provide for the so-called \u201c<strong>double filing<\/strong>\u201d, that is to say the chance to file a patent application both as an invention and as a utility model, leaving the choice up to the Office, together with the chance to <strong>transform<\/strong> a patent application in a utility model one and vice versa.<\/p>\n<p>In this case as well the protection lasts <strong><u>10 years<\/u><\/strong> starting from the filing of the application before the UIBM and it is not renewable.<\/p>\n<p><strong><a href=\"https:\/\/barzano-zanardo.com\/en\/ip-strategy\/design\/\" target=\"_blank\" rel=\"noopener\">DESIGN and MODELS<\/a><\/strong>\u00a0protect the mere exterior aspect of a product, so basically its shape.<\/p>\n<p>Such aspect should have <strong>no technical or practical purpose<\/strong> in order to be protected but <strong>only a purely esthetic significance<\/strong>: in other words, it should have no function other than the exterior and esthetic characterization of the product.<\/p>\n<p>The <strong>requirements<\/strong> to register and give validity to them are the novelty and the individual character.<\/p>\n<p>A Design is <strong>new<\/strong> if there are no identical designs or models spread before its application was filed; it has an <strong>individual character<\/strong> if it is capable of evoking a <strong>different general impression <\/strong>in an informed user compared to any other previous design.<\/p>\n<p>A design should essentially look like something new and different to an expert subject of the concerned sector.<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-full wp-image-2358\" src=\"https:\/\/barzano-zanardo.com\/wp-content\/uploads\/2019\/04\/Le-Privative-Industriali2.png\" alt=\"\" width=\"1074\" height=\"559\" \/><\/p>\n<p>Exclusive rights upon designs and models are granted with the <strong><u>registration<\/u><\/strong> and are valid on the whole national territory for a period up to <strong><u>25 years<\/u><\/strong>.<\/p>\n<p>However, the EU regulation allows protection also to those designs and models which are not registered for a period up to <strong><u>3 years<\/u><\/strong> starting from the first disclosure in the EU territory. This deadline is not extendable and, once expired, it doesn\u2019t allow the protection resulting from registration.<\/p>\n<p>Finally, it is important to analyze the regulation regarding <a href=\"https:\/\/barzano-zanardo.com\/en\/ip-strategy\/copyright\/\" target=\"_blank\" rel=\"noopener\"><strong>COPYRIGHT<\/strong><\/a>.<\/p>\n<p>Copyright protects <strong>works with creative character <\/strong>belonging to music, literature, figurative arts, architecture, cinema etc. Considering that there\u2019s <strong>no peremptory list<\/strong> of the works capable of being protected, with the rise of new art forms and expressions of human creativity, more and more works ended up obtaining this kind of protection (for example <em>software<\/em>, <em>databases<\/em>).<\/p>\n<p>Contrary to what people commonly think, there is <strong>no necessary application or registration<\/strong> in order to establish such right. Copyright is effective with the simple creative act and in that precise moment.<\/p>\n<p>It is up to the author to demonstrate its <strong>authorship<\/strong> and the <strong>date<\/strong> of the same. The application filed to SIAE, for example, has this particular function to certify and prove the origin of the work.<\/p>\n<p>The rights granted to the author are divided into two categories: the <strong>rights of economic exploitation<\/strong> and the <strong>author\u2019s moral right<\/strong>.<\/p>\n<p>The former regard the possibility to use and commercially exploit a work and can be <strong>freely<\/strong> <strong>transferred<\/strong> in the market.<\/p>\n<p>The latter corresponds to the right of the author to be <strong>acknowledged<\/strong> and to oppose to any amendment of his\/her work that could be prejudicial to his\/her honor and reputation.
