{"id":2997,"date":"2019-11-18T12:49:04","date_gmt":"2019-11-18T11:49:04","guid":{"rendered":"https:\/\/barzano-zanardo.snaptest.it\/?post_type=approfondimenti&#038;p=2997"},"modified":"2019-11-18T12:49:05","modified_gmt":"2019-11-18T11:49:05","slug":"fakes-purchasers-should-fear-fines-and-crimes","status":"publish","type":"approfondimenti","link":"https:\/\/barzano-zanardo.com\/en\/approfondimenti\/fakes-purchasers-should-fear-fines-and-crimes\/","title":{"rendered":"Fakes\u2019 Purchasers Should Fear Fines and Crimes"},"content":{"rendered":"<p>The mentioned rules may appear much more meaningful if you only consider the enormous damages that <a href=\"https:\/\/barzano-zanardo.com\/en\/brand-protection\/anti-counterfeiting\/\" target=\"_blank\" rel=\"noopener\">counterfeiting<\/a> generates: more than 140 Euros lost by every single Italian citizen each year (EUIPO 2018), 88.000 full-time employees lost in sectors damaged by fakes (OCSE 2019), just to give a couple of quick but incisive examples!<\/p>\n<p>In other words, <a href=\"https:\/\/barzano-zanardo.com\/en\/brand-protection\/anti-counterfeiting\/\" target=\"_blank\" rel=\"noopener\">counterfeiting<\/a> creates negative consequences on the whole Community!<\/p>\n<p>Hence, the classification of counterfeiting as administrative offence \u2013 in the above mentioned Legislative Decree 35\/05 \u2013 describes residual conducts, whereas for the Italian Criminal Code <a href=\"https:\/\/barzano-zanardo.com\/en\/brand-protection\/anti-counterfeiting\/\" target=\"_blank\" rel=\"noopener\">counterfeiting<\/a> is a crime.<\/p>\n<p>Namely, more than one criminal offence related to counterfeiting is provided by the Italian Criminal Code, grounded on the precept that counterfeiting violates the Public Interest of, among other, the certainty of economic and juridical relations.<\/p>\n<p>Several case-law decisions rose from the said principle to give exact interpretations of criminal rules against counterfeiting, and consequently <a href=\"https:\/\/barzano-zanardo.com\/en\/brand-protection\/enforcement\/\" target=\"_blank\" rel=\"noopener\">prevent<\/a> fakes\u2019 importers or resellers to carry on their illicit trade running the sole risk of a fine, despite abstractly high.<\/p>\n<p>In conclusion, the regulatory and punitive framework appears correctly articulated: fakes\u2019 purchasers are responsible, at each level, towards the People they are part of.
