{"id":3083,"date":"2019-12-24T09:07:36","date_gmt":"2019-12-24T08:07:36","guid":{"rendered":"https:\/\/barzano-zanardo.snaptest.it\/?post_type=approfondimenti&#038;p=3083"},"modified":"2019-12-24T09:07:36","modified_gmt":"2019-12-24T08:07:36","slug":"pct-published-the-implementing-decree-for-the-italian-national-phase","status":"publish","type":"approfondimenti","link":"https:\/\/barzano-zanardo.com\/en\/approfondimenti\/pct-published-the-implementing-decree-for-the-italian-national-phase\/","title":{"rendered":"\u201cPCT &#8211; published the implementing decree for the Italian national phase\u201d"},"content":{"rendered":"<p>In particular, the recently published <strong>Ministerial Decree<\/strong> dated<strong> 13 November 2019,<\/strong> and issued by the <strong>Italian<\/strong> <strong>Ministry of Economic Development<\/strong>, confirmed that the direct entry into the Italian national phase will come into force for International applications according to the Patent Cooperation Treaty, which explicitly designate or elect Italy, filed <strong>on <\/strong>or<strong> after <\/strong>the<strong> 1<sup>st<\/sup> <\/strong>of<strong> July 2020<\/strong>.<\/p>\n<p>The <strong>entry<\/strong> into the Italian national phase shall be requested <strong>within thirty months<\/strong> from the filing date of the International application or its priority date.<\/p>\n<p>Upon entering the Italian national phase, or within two months from the date of entry, an <strong>Italian translation<\/strong> of the International application as published shall be provided, together with the Italian translation of any further amendment made during the International phase pursuant to articles 19 , 34 or 41 PCT.<\/p>\n<p>The <strong>examination<\/strong> of the Italian patent application will not start before the <strong>30<sup>th<\/sup> month<\/strong> from the filing date of the International application, or from its priority date, and will be based on the <strong>International Research Report<\/strong>.
