{"id":6973,"date":"2023-01-30T12:20:01","date_gmt":"2023-01-30T11:20:01","guid":{"rendered":"https:\/\/barzano-zanardo.com\/?post_type=approfondimenti&#038;p=6973"},"modified":"2023-01-30T12:20:01","modified_gmt":"2023-01-30T11:20:01","slug":"new-administrative-invalidity-and-revocation-procedure-in-italy-before-italian-pto","status":"publish","type":"approfondimenti","link":"https:\/\/barzano-zanardo.com\/en\/approfondimenti\/new-administrative-invalidity-and-revocation-procedure-in-italy-before-italian-pto\/","title":{"rendered":"New administrative invalidity and revocation procedure in Italy before Italian PTO"},"content":{"rendered":"<p>These administrative proceedings represent an additional tool for trademark owners who may choose to file an invalidity or revocation action through administrative proceedings or before the ordinary courts; court proceedings remain available as an alternative, even though more expensive, route.<\/p>\n<p>Invalidity\u00a0and\u00a0revocation\u00a0proceedings\u00a0may\u00a0be\u00a0initiated\u00a0with\u00a0the\u00a0filing\u00a0(both\u00a0electronically\u00a0and\u00a0on\u00a0paper)\u00a0of\u00a0an\u00a0application\u00a0in\u00a0Italian\u00a0before\u00a0the\u00a0IPTO.<\/p>\n<p>This\u00a0application\u00a0must\u00a0be\u00a0written,\u00a0motivated, aimed\u00a0at\u00a0requesting\u00a0the\u00a0verification\u00a0of\u00a0invalidity and\u00a0complete\u00a0of\u00a0the\u00a0supporting\u00a0documentation,\u00a0as\u00a0well\u00a0as\u00a0the instrument of appointment, if any.<\/p>\n<p>If the application is admissible, the IPTO sends to both parties a communication in which it grants an initial period of two months to try to reach an amicable settlement, this period may be extended several times at the joint request of the parties up to a maximum of one year.<\/p>\n<p>In the absence of agreement, the owner of the contested trademark is given a further 60 days to file observations and, where applicable, to file any request for proof of use.
